Hollow victory for caste discrimination campaigners?

THE introduction of a clause to amend the Equality Act and make caste discrimination illegal in the UK, in the Enterprise and Regulatory Reform Act, was thought to be a great victory for campaigners just a few months ago, but this week the Government has announced a timetable for consultations and reports that indicates legislation will not be implemented before the summer of 2015.

Raj Chand, chairman of the Anti-Caste Discriminatory Alliance, told the BBC: “The timescales are ridiculous. It’s clear this Government doesn’t want to do anything in relation to bringing it into force and implementing it in the near future.

“They are not treating this particular group like any other.”

He added: “We know there’s a very strong anti-legislation lobby that’s been in touch with the Government. Without doubt, the Government has been listening.

“It’s a really appalling show by the Government. They say they are pushing for equality, but it seems some groups are far more equal than others.”

The Government Equalities Office announcement this week said: “The Government is committed to eliminating caste-based discrimination and harassment in the UK and plans to carry out a full public consultation on the prospective legislation in early 2014.

“That consultation will draw on existing reports, as well as the findings of research on caste and caste discrimination which the Equality and Human Rights Commission will carry out shortly.

“The Commission’s research is due to last around three to six months from summer 2013, and will include discussions with people and groups who are interested in caste discrimination.

“Taking this timetable into account, the public consultation is expected to issue in February or March 2014, will run for twelve weeks and conclude around May-June 2014.  It will seek views from stakeholders and the public.

“During Summer 2014, while Government is analysing the responses to the consultation, we will also carry out some sector-specific engagement with representatives of groups including employers, public authorities and the judiciary, who will need, but at present almost certainly lack, familiarity with caste and the potential requirements of the new legislation.

“The Government’s response to the consultation, which will include a draft Affirmative Order outlawing caste discrimination, will be drawn up during this period. The response and draft Order are expected to issue in autumn 2014, with the latter exposed for public consultation for twelve weeks.  Allowing for Christmas this consultation is expected to close in February 2015, with the final draft Order likely to be introduced into Parliament during summer 2015.”
